The agreement that governs use of the platform.

01Agreement to terms

By accessing or using Zaras AI ("Service"), operated by ZARAS AI LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

02Description of service

Zaras AI is a cloud-based field service management platform that provides scheduling, dispatch, customer management, estimates, invoicing, reporting, and communication tools for small businesses.

03Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

04Acceptable use

You agree not to misuse the Service, including but not limited to: attempting to gain unauthorized access, transmitting harmful code, violating any applicable laws, or using the Service to send unsolicited communications (spam).

05Subscription & payments

Certain features of the Service require a paid subscription. Fees are billed in advance on a monthly basis. All payments are processed securely through our third-party payment processor (Stripe). You agree to provide valid payment information and authorize recurring charges. Prices may change with 30 days' notice.

06Refund & cancellation

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period, and no refunds are provided for partial billing periods. Free tier users may delete their account at any time.

If we terminate your account without cause, you will receive a prorated refund for the remaining portion of your billing period.

07SMS/text messaging terms

By providing a phone number when using the Service — whether as a business account holder or as a customer whose information is entered into the platform — you may receive service-related text messages sent through the Zaras AI platform. These messages may include:

Consent. End-user customers of businesses using Zaras AI consent to receive SMS messages when they provide their phone number during the service engagement process. Consent is collected by the business through an opt-in disclosure presented during service intake, which includes the following language:

"I agree to receive automated SMS messages from [Business Name], including appointment reminders, job updates, and service communications. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to cancel. View our Privacy Policy & Terms of Service."

Businesses using Zaras AI are responsible for collecting proper consent from their customers before sending messages through the platform.

Message frequency. Message frequency varies based on service activity, such as the number of scheduled appointments, pending estimates, or active jobs associated with the customer's record.

Message and data rates. Standard message and data rates may apply depending on your mobile carrier and plan.

Opt-out. You may opt out of text messages at any time by replying STOP to any message. You may also text CANCEL, END, QUIT, UNSUBSCRIBE, or OPTOUT. After opting out, you will receive a single confirmation message and no further texts will be sent. Opting out of SMS notifications does not cancel any underlying service agreement.

Help. Reply HELP to any message for assistance. You will receive a reply with support contact information. You may also contact us directly at support@zaras.ai.

No sharing. We will not share mobile contact information, opt-in data, or SMS consent with third parties or affiliates for marketing or promotional purposes.

Carrier liability. Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and compatibility with your device.

08Data & content

You retain ownership of all data you submit to the Service ("Your Data"). You grant us a limited license to host, store, and process Your Data solely to provide the Service. We will not sell or share Your Data with third parties except as necessary to operate the Service.

09Service availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance or due to factors beyond our control.

10Limitation of liability

To the maximum extent permitted by law, ZARAS AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees you have paid in the twelve months preceding the claim.

11Termination

Either party may terminate the agreement at any time. Upon termination, your right to access the Service ceases. We may retain Your Data for a reasonable period to allow you to export it, after which it will be deleted.

12Changes to terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.

13Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
